General Terms and Conditions (GTC)
1. Scope
The following GTC apply to all orders placed via our online shop. Our online shop is aimed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his or her trade, business or profession. An entrepreneur is any natural or legal person or partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of his or her trade, business or professional activity.
2. Contractual partner, conclusion of contract, corrections
The purchase contract is concluded with mimodo AG.
By displaying the products in the online shop, we submit a binding offer to conclude a contract for these items. You may first place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order, using the correction tools provided and explained during the order process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by e-mail.
3. Contract language, storage of the contract text
The language(s) available for concluding the contract are: German, English, French, Dutch, Spanish, Italian.
The text of the contract is not stored by us.
4. Delivery conditions
We deliver free of shipping charges according to the conditions set out in our shipping policy.
We deliver by shipping only. Collection of the goods in person is unfortunately not possible.
We do not deliver to parcel lockers.
5. Payment
The following payment methods are generally available to you in our shop:
Advance payment
If you choose advance payment, we will send you our bank details in a separate e-mail and deliver the goods after payment has been received.
Credit card
You enter your credit card details during the ordering process. Your card will be charged immediately after placing the order.
PayPal
In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. You will receive further information during the ordering process.
PayPal may offer registered PayPal customers selected according to its own criteria additional payment methods within their customer account. We have no influence on whether these methods are offered; additional individually offered payment methods concern your legal relationship with PayPal. You will find further information on this in your PayPal account.
6. Retention of title
The goods remain our property until full payment has been received.
7. Transport damage
If goods are delivered with obvious transport damage, please report such defects to the carrier as soon as possible and contact us without delay. Failure to make a complaint or to contact us has no consequences for your statutory rights and their enforcement, in particular your warranty rights. However, it helps us to assert our own claims against the carrier or the transport insurance.

9. Liability
For claims based on damages caused by us, our legal representatives or vicarious agents, we are liable without limitation:
- in the event of injury to life, body or health;
- in the event of intentional or grossly negligent breach of duty;
- in the event of warranty promises, insofar as agreed; or
- insofar as the scope of application of the Product Liability Act is opened.
In the event of a breach of material contractual obligations — the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) — by slight negligence on our part, that of our legal representatives or vicarious agents, liability is limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.
In all other cases, claims for damages are excluded.

11. Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR) available here. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
In case of discrepancies, the German version of these GTC is the legally binding version.
